1. Overview

This Privacy Policy explains how ABGs ("we," "us," or "our") collects, uses, discloses, and protects personal information when you use the ABGs website (abgs.app), AI character messaging services, and related features (collectively, the "Services"). By using the Services, you consent to the practices described in this policy.

2. Information We Collect

A. Information you provide directly

  • Messages and prompts — text content you send to ABGs characters via Instagram DM or iMessage
  • Contact identifiers — your phone number (for iMessage) or Instagram username/handle (for DM) when you initiate contact
  • Payment information — when you subscribe, Stripe collects your payment details (card number, billing address). We receive your Stripe customer ID, subscription status, and transaction amounts, but we do not store your full card number
  • Files and media — any images, files, or attachments you send through messaging channels

B. Information collected automatically

  • Website analytics — page views, referral source, device type, and browser information via Vercel Analytics (privacy-friendly, cookieless)
  • Message metadata — timestamps, delivery status, message identifiers, and conversation thread identifiers
  • IP address — used transiently for analytics aggregation and abuse prevention; not stored in association with your identity

C. Information generated by the Services

  • AI-generated responses — text and image content generated in response to your messages
  • Conversation context — session state, memory, and context maintained to provide coherent ongoing conversations
  • Usage metrics — image generation counts, rate-limit state, subscription status per character

3. How We Use Your Information

  • To generate and deliver AI character responses to your messages
  • To generate AI images when requested or contextually appropriate
  • To maintain conversation context and memory across sessions
  • To process payments and manage your subscription
  • To enforce rate limits, usage policies, and our Terms of Service
  • To detect, prevent, and respond to abuse, fraud, and security incidents
  • To improve AI response quality and the overall Services
  • To analyze aggregate usage patterns (not individually identifiable)

4. AI Processing of Your Data

Your messages are processed by third-party AI language models (including Anthropic Claude and others) to generate responses. This processing involves:

  • Sending your message content to AI model providers for inference
  • Maintaining conversation history to provide contextual responses
  • In some cases, using web search tools to provide relevant information

AI model providers process your data under their own data processing agreements with us. We select providers that commit to not using your data to train their models without consent. However, we cannot guarantee the data practices of third-party AI providers beyond our contractual agreements.

5. AI-Generated Images

When the Services generate images (e.g., character selfies), your request is processed by third-party image generation models. These services receive the generation prompt and reference images but not your personal identity information. Generated images are stored temporarily and associated with your conversation thread.

6. Third-Party Services & Data Sharing

We integrate with the following third-party services, each of which processes some of your data under their own privacy policies:

  • Instagram / Meta — message delivery for DM interactions. Subject to Meta's Privacy Policy
  • Apple iMessage / SMS carriers — message delivery for iMessage interactions. Subject to Apple's Privacy Policy and your carrier's policies
  • Stripe — payment processing. Subject to Stripe's Privacy Policy
  • Anthropic — AI language model provider for generating responses
  • Cloudflare — infrastructure, data storage, and content delivery
  • Vercel — website hosting and privacy-friendly analytics
  • fal.ai — AI image generation

We do not sell your personal information to third parties. We do not share your data with third parties for their own marketing purposes.

7. Data Storage & Retention

  • Messages — retained for as long as necessary to provide the Services, maintain conversation context, and improve AI quality. Older messages may be pruned from active conversation context but retained in storage
  • Payment records — retained for as long as required by applicable tax and financial regulations, or until you request deletion
  • Analytics data — retained in aggregate form; individual session data is not persisted
  • Account identifiers — retained until you request deletion or your account is terminated

Data is stored on Cloudflare infrastructure in the United States. By using the Services, you consent to the transfer and processing of your data in the United States.

8. Data Security

We implement industry-standard security measures to protect your information, including encryption in transit (TLS), access controls, and secure infrastructure. Payment information is handled entirely by Stripe and never touches our servers.

However, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security and are not responsible for unauthorized access resulting from circumstances beyond our reasonable control.

9. Your Rights

Depending on your jurisdiction (including under CCPA, GDPR, and other applicable laws), you may have the right to:

  • Access — request a copy of the personal information we hold about you
  • Deletion — request deletion of your personal data, including message history and account information
  • Correction — request correction of inaccurate personal information
  • Portability — receive your data in a structured, machine-readable format
  • Opt out — opt out of certain data processing activities
  • Non-discrimination — we will not discriminate against you for exercising your privacy rights

To exercise any of these rights, email support@abgs.app with your request. We will respond within 30 days (or sooner if required by applicable law). We may need to verify your identity before processing your request.

10. Children's Privacy

The Services are strictly for users aged 18 and older. We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected data from a minor, we will delete it promptly. If you believe a minor has provided us with personal information, please contact us immediately at support@abgs.app.

11. Cookies & Tracking

The ABGs website uses Vercel Analytics, which is a cookieless, privacy-friendly analytics solution. We do not use tracking cookies, advertising pixels, or cross-site tracking technologies on our website.

12. California Privacy Rights (CCPA)

If you are a California resident, you have the right to: (a) know what personal information we collect and how it is used; (b) request deletion of your personal information; (c) opt out of the sale of your personal information (we do not sell personal information); and (d) not be discriminated against for exercising your rights. 13. International Users

If you access the Services from outside the United States, your information will be transferred to and processed in the United States. By using the Services, you consent to this transfer. We will take reasonable steps to ensure your data is treated in accordance with this Privacy Policy.

14. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be reflected in the "Last updated" date at the top of this page. We encourage you to review this policy periodically. Your continued use of the Services after changes constitutes acceptance of the updated policy.
