1. About ABGs

ABGs ("we," "us," or "our") operates the website at abgs.app and related services (collectively, the "Services"). ABGs is an AI-powered entertainment platform that provides fictional character experiences accessible through Instagram Direct Messages and Apple iMessage. By accessing or using the Services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to access or use any part of the Services. By using the Services, you represent and warrant that you are at least 18 years of age. We reserve the right to terminate access for any user we reasonably believe to be under 18. The Services are not directed to children under 18, and we do not knowingly provide the Services to minors.

3. AI Disclosure — All Characters Are Fictional

All personas, characters, names, ages, biographical details, profile images, and conversations on ABGs are entirely fictional and generated by artificial intelligence. No character on ABGs is a real person. Character images are AI-generated and do not depict any real individual. Any resemblance to real persons, living or dead, is purely coincidental.

When you interact with an ABGs character, you are communicating with an AI system — not a human being. Responses are generated by large language models and do not represent the views, opinions, or advice of any real person or of ABGs.

AI-generated content may be inaccurate, inconsistent, or inappropriate. You should not rely on any information provided by ABGs characters for medical, legal, financial, or other professional advice.

4. Messaging Channels & Consent

A. How messaging works

The Services deliver AI-generated character responses through third-party messaging platforms, including but not limited to Instagram Direct Messages and Apple iMessage/SMS. When you initiate a conversation with an ABGs character through any channel, you expressly consent to receiving AI-generated messages in response.

B. Third-party platform terms

Your use of Instagram, iMessage, or any other messaging platform to interact with ABGs is also subject to that platform's own terms of service and privacy policy. ABGs is not responsible for the actions, policies, or content decisions of third-party platforms.

C. Opting out

You may stop receiving messages at any time by ceasing to send messages to ABGs characters. For iMessage, you may also block the number. For Instagram, you may unfollow, mute, or block the account.

5. AI-Generated Images

Certain features of the Services may deliver AI-generated images to you. These images are created by artificial intelligence models and do not depict real people, real events, or real places. AI-generated images may be imperfect, unrealistic, or contain artifacts. You acknowledge that all images are synthetic and fictional.

We may impose rate limits on image generation features. Image generation availability and quality are not guaranteed.

6. Paid Subscriptions

A. Subscription plans

Certain features of the Services, including premium character interactions and AI-generated image content, require a paid subscription. Subscription pricing is displayed before purchase.

B. Payment processing

Payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service. Your payment information is handled directly by Stripe and is not stored on our servers.

C. Recurring billing

Subscriptions are billed on a recurring basis (monthly or as specified at checkout). You authorize us to charge your payment method on each billing cycle until you cancel.

D. Cancellation & refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods. If you believe you were charged in error, contact us at support@abgs.app within 14 days of the charge.

7. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law
• Attempt to extract, scrape, reverse-engineer, or derive the underlying AI models, prompts, or systems
• Send content that is illegal, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to bypass rate limits, payment requirements, or access controls
• Use the Services to generate content that exploits, harms, or endangers minors
• Redistribute, resell, or publicly display AI-generated images or conversations without our written permission
• Impersonate any person or misrepresent your identity or age
• Use automated scripts, bots, or tools to interact with the Services

We reserve the right to suspend or terminate your access at any time, without notice, for conduct that we determine violates these Terms or is harmful to the Services or other users.

8. Intellectual Property

All content on ABGs — including AI-generated images, character designs, character names and personas, logos, website design, and software — is owned by ABGs or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any ABGs content without our prior written consent.

You retain ownership of the messages you send to ABGs. By sending messages, you grant ABGs a non-exclusive, worldwide, royalty-free license to use, process, and store your messages for the purpose of providing and improving the Services.

9. Content Disclaimer

The Services may generate content that is suggestive, flirtatious, or mature in nature. By using the Services, you acknowledge that you may encounter such content and that you are accessing it voluntarily as an adult. ABGs does not guarantee that AI-generated content will be appropriate, accurate, or consistent.

ABGs is an entertainment service. Nothing generated by the Services should be construed as professional advice, a factual representation, or an endorsement of any kind.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABGS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ABGS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICES EXCEED THE AMOUNT YOU PAID TO ABGS IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless ABGs and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page. Your continued use of the Services after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
